A key feature of the web is the possibility for every website to provide links to other web pages at the touch of a mouse..... A number of ways in which web pages can be linked together, each with different regulatory implications for obtaining permits. In this section, we discuss the problems that occur when your site links to other Web pages and provide an example link arrangement.

DeRich: Is an authorization required to publish web sites in a work? Rather Rich: Do I need to be allowed to publish web pages in a weblog? I want to integrate all sites are available via Google. Will I need to get approval for each page or do I need to get involved with Google?

There is no need to worry about it either; no authorization is needed if you provide the name or the public web site name. The only way to encounter issues is to deliberately list or link to web pages that encourage harm - such as parental content, download resources, or web pages that disclose sensitive information or violate your private life.

There are two commonly used ways of connecting web pages to other sites: linkage and frame. In most cases, a website connects to another in the shape of a hyperlink (also known as a "hypertext" link), a specifically encoded text or picture that, when you click on it, takes a visitor to another website.

Links may take the reader to another page within the same site (an "internal link") or to another site as a whole (an "external link"). They do not require authorization for a standard MS Office website to provide a standard MS Office URL to another website. When there are some concerns about the links, most problems can be resolved by the site signing a links contract that gives your links approval.

In spite of some inconsistency in early case law, it is generally accepted that Deep linking (a hyperlink that circumvents the home page of a website) does not constitute a violation of copyrights - after all, the writer of a novel cannot stop the reader from jumping to the end first if he wishes, so why should the website owners have the right to decide in which order a visitor can visit a website?

While many Web sites, including the listener-friendly National Public Radio, have claimed copyrights and trademarks against Deep-Linker, the cases brought by Kelly v. Arriba Soft Corp. In addition to the use of third-party web sites, there is another way to access other web sites from your site: "framing". "Frame is a kind of link where you encode a text or picture so that it connects to another web page when the clicked on.

The unique feature of this website is that the information does not reach the website to which the link is made, but is instead transferred to the source page and presented in a specific "frame". For example, when you click on "Read Autosport News," the contents of the autosport website on John's RacingVision's website will appear in a box.

While reading the messages from Autosport, the user's computer is still linked to John's website, not Autosport. Framming is generally not popular with web pages whose contents are displayed on another page (unless you have given your consent). Web pages that border the contents of other Web pages are often regarded as theft of the contents of the other Web page.

However, a tribunal ruled that frame is a violation of copyrights, as the procedure has led to unauthorised alteration of the site to which the link refers. On another case, the Washington Post, CNN and several other intelligence firms were suing a website, TotalNews, which was frame-wrapping their message on. As part of a settlements arrangement, TotalNews has consented to discontinue frame and use only text-link.

"The term "inlining" (sometimes also known as " reflecting ") refers to the integration of a graphics data from one website to another. 336 F.3d 811 (Cir. 9, 2003)), an online photo finder named ditto.com used full-scale reproduction hyperlinks from a photographer's website. Click on the hyperlink to open a screen with a full-size picture that has been uploaded from the photographer's website, encircled by the advertisements of the searching engin.

However, the Appellate Body in the Kelly case confirmed the court's decision that the use of the tracing engine's policy of making small thumbnail copies of the pictures and displaying them on its own website was allowed as true use. They were much smaller and of much worse qualitiy than the originals and were used to index the pictures and make them accessible to the population.

Except when you know that a website does not oppose (and prefers to have your written consent), you should be very careful when framing its inscription. As with all approval arrangements, the aim of a linkage arrangement is to prevent disputes. The majority of web sites do not pose questions of a juridical nature, and if a site manager is convinced that a web site does not cause a conflict, then a binding contract is probably not necessary.

The following kinds of hyperlinks can, however, lead to disputes: inserting hyperlinks that only contain certain items of a website, such as an illustration. Authorization may be formless, such as a letter from the remote site stating: "You have the right to use the words [insert the words into the link] to refer to the home page of our website.

" Or you can use a longer term arrangement that more closely matches the conditions. You may use the following arrangement to prevent any dispute about this type of linking. It contains the target page and:: Hypertext-Phrase - the words: Picture link: Framed link: The target page gives the right to show the linked site on the source page and the non-exclusive right to show the brands or pictures in the linked site in public.

This Agreement does not grant any trade mark right to source site except the right to view the trade mark. At the time of acquisition, any excess of the cost of any acquisition over the fair value of the net assets acquired is recognized in the income statement. SourcSite must keep its website in compliance with applicable industrial norms and must immediately delete the links upon notification of Destination Site, if necessary.

Postal addres of the destination: Add the name of the name of the firm or individual who owned the original page to the introduction section. This is the page on which the links are to be found, i.e. the point of origin for the links.

Grant allows the use of the links and associated brands or pictures. One of the requirements of trade mark legislation is the claim "Any good will associated with sourcesite brands is transferred to the target site automatically". They guarantee that the place of delivery retains its trade mark laws. Optionally, the Standards and Notification section is another security that is sometimes requested by a target page that the original page does not function illegally or drastically changes the links.

Although this section is not available, the target page can probably enforce the deletion of the links if it wishes. It is advisable for both sides to conclude the Memorandum of Understanding. Add any information you want to use for your arrangement. In order to minimise the responsibility for any activity that occurs when a user is directed to a hyperlinked website, a website master may insert a legal exclusion of responsibility on the homepage.

Rich: Can I publish screen shots on my website? I will use many screen shots from different web sites in my work. Is this a requirement for a permit or is it a use? Intellectual property rights holders do not wish to make a complaint about anything that their organization encourages - for example, an on-line Microsoft Word usage guide or a eBay store creation guide - or (2) intellectual property rights holders believe that the use is likely to be justified as good use.

There are some pages that limit your use of screen shots in their terms of use. Remember that if copyrights are complaining, the results can be unhappy - it can interfere with the publishing of a work or other work.
